Summary
Assuring them that his clients do not wish to delay the proceedings but he has advised them that it will not be safe "to have the Cause brought to a hearing until the written Instructions for Lady Baths Will are incorporated in the probate...There has been a considerable delay in consequence of our not being able to obtain the Facts & circumstances attending the Execution of the Instructions and Will until Mr. Kiplings answer was put in. I should hope that the Proceedings in Doctors Commons may be accelerated so as to get the necessary Decree in the course of the present Term which being done I apprehend there can be no obstacle in the way of proceeding to a Hearing in the Chancery Suit; so far at least as to get an Order for taking the account."
