Potts gave May a promissory note for $70. After Potts failed to pay, May sued Potts to collect the debt. The Justice of the Peace ruled for May and awarded $70.87. Potts gave Baker, a constable, $70 to satisfy part of the judgment, but Baker subsequently left for California. May asked the Justice of the Peace to issue an execution to satisfy the full judgment. Potts paid Crouch, the constable, $2.95 to satisfy the judgment, but Potts feared that Crouch would attempt to seize property to pay the remaining $70. Potts sued for an injunction to stop the execution of the judgment, and May retained Lincoln and Herndon. The parties reached an agreement in which Potts paid May $35, and the court dismissed the case. Cf. The law practice of Abraham Lincoln, second edition, file id L04342.
